PERLINDUNGAN KONSUMEN ATAS PENYALAHGUNAAN FITUR SHOPEE PAYLATER YANG DILAKUKAN PIHAK KETIGA
Abstract
Financial Technology has a big influence on the economy, especially in the advancement of the marketplace, one of which Shopee has presented an innovation, namely the Shopee Paylater feature. However, the presence of Shopee Paylater actually becomes a gap for irresponsible parties to carry out account hacking actions. Therefore, legal protection is needed for Paylater users and strict security of user data to prevent acts of data misuse or account hacking by third parties. This includes both preventive measures, such as secure authentication systems, and repressive measures, such as legal recourse for affected users. The rapid expansion of financial technology demands a robust regulatory framework to protect users from potential harm, especially in the context of digital transactions that involve sensitive personal data and credit information. The problems studied in this article are how to protect Paylater consumers, what are the legal consequences for third parties who abuse Shopee Paylater, and efforts to resolve disputes in the event of Shopee Paylater abuse. The research method used is normative juridical, through a conceptual approach and legislation. The results of this study indicate that Paylater consumer protection consists of preventive and repressive protection, third parties who abuse the Shopee Paylater feature can be sued for civil compensation under criminal sanctions, and dispute resolution that can be taken by consumers can be through arbitration by LAPS SJK. Strengthening the legal framework and enforcement will be crucial to ensure users' trust and confidence in using these services without fear of data breaches, fraudulent actions, or misappropriation of sensitive financial data.
